GENERAL TERMS & CONDITIONS (T&C)
of the Ski School and Sport Warth GmbH & Co KG (FN 319489m) - hereinafter referred to as "Ski School Warth" for short - located in A-6767 Warth.
For all declarations of the Warth ski school and for all legal transactions with its contractual partners, these GTC apply unless expressly agreed otherwise.
2. Conclusion of contract and prices:
Bookings of courses can be made directly in the ski school office, by mail, by phone, by online store, by payment link and many other portals. However, a contract is only concluded by written confirmation from the Warth Ski School. All offers of the Warth ski school are subject to change. The respective concrete scope of services results exclusively from the written order confirmation. Verbal additional agreements are only binding in case of an explicit written confirmation by the Warth ski school. All prices are in Euro and include - unless otherwise agreed - also the legal sales tax. The tariffs are based on the tariff system "Dynamic Pricing" and the tariffs are indicated with "from" prices. The listed "from" prices are the best prices that are possible when booking early enough. The change of all prices indicated on the Internet or on price lists is expressly reserved.
3. Terms of payment:
Unless otherwise agreed, a deposit of 100% of the order amount is to be paid after receipt of the written order confirmation. The down payment has to be made in time so that it is received on the account of the Warth ski school at least seven bank days before the start of the course. The final settlement of the respective course takes place after its completion. For contracts concluded directly on site, the fee is to be paid either directly to the ski instructor or at the ski school office. Also a payment by contemporary payment systems by cell phone, various links and other possibilities are used. In case of late payment, interest on arrears of 6% p.a. will be charged.
Credit card payments in favor of the Ski School will be collected by TREKKSOFT AG, Hauptstrasse 15, 3800 Matten, Switzerland ("TREKKSOFT"). TREKKSOFT will appear as TREKKSOFT TOUR BOOKING on your credit card statement. The domain where you enter and process your payment is owned and operated by TREKKSOFT. Please email email@example.com for all inquiries regarding your credit card payments and chargebacks.
4. Mutual rights and obligations:
The contract partner is obligated to inform the Warth ski school truthfully and comprehensively about his abilities and experience in skiing, as well as to independently provide for equipment that corresponds to the state of the art and the external conditions. Furthermore, he/she has to inform the Warth ski school comprehensively about his/her physical abilities, in particular his/her state of health as well as any existing ailments and disabilities. The contractual partner must independently arrange for the inspection of his ski equipment, in particular the proper adjustment of the ski binding by a specialist company, in good time before the start of the course.
The group division for ski courses is carried out by the Warth Ski School. If a group is reduced to less than 4 participants, we reserve the right to combine them. If it is not possible to combine the groups because of the difference in ability, the lesson times will be shortened. If there are 4 or more participants, the classes will always take place during the normal class times. If the number of participants is less than 4, the course times will be adjusted accordingly: If there are 3 participants, there will be a 3-hour course. If there are 2 participants, the course lasts 2 hours. With one participant there will be 1 hour course. A multiple change of teachers is possible due to the flexible organization. If during the course a different classification of the participant is necessary, the contract partner has to follow this decision. Otherwise, the Warth ski school is entitled to terminate the contract prematurely. The contract partner has to follow the instructions of the Warth ski school. The persistent disregard of these instructions entitles the Warth ski school to the immediate cancellation of the contract. The participation in courses of the Warth ski school under the influence of alcohol or drugs also entitles the Warth ski school to the immediate cancellation of the contract. The contract partner has no right to a refund of the paid fee in case of a contract termination for the mentioned reasons.
5. Liability regulations:
The Warth ski school is not liable for damages of guests/customers which are connected with the activity of the Warth ski school, unless these are caused intentionally or by gross negligence. The Warth ski school has an appropriate liability insurance. In particular, the Warth ski school assumes no liability for indirect or consequential damages.
Guests and participants are not insured by the Warth ski school. It is recommended that each participant takes out appropriate accident and liability insurance and is the responsibility of each individual customer/guest.
The contract partner has to address any complaints immediately to the ski school office. In case of culpable omission of this duty of notification, there is no right to a reduction of the fee. All claims against the Warth ski school are to be asserted in writing within a maximum of two weeks after they arise and must be accompanied by an appropriate justification.
7. Withdrawal and cancellation fee:
Withdrawal from the contract is possible up to 14 days before the start of the course at the latest.
From 14 days before the start of the course and during the time of the booked service, 100% of the agreed amount will be charged.
For cancellations of booked courses less than 14 days before the start of the course, a confirmation will be issued for submission to the respective travel cancellation insurance.
In case of cancellation of a group course due to an accident or illness, a medical certificate from a doctor (member of the Austrian Medical Association and with minimum admission in general medicine) must be presented together with the original receipt in order to receive the amount minus the processing fee in the form of a credit note.
The amount of the credit note will be calculated taking into account the actual services already rendered (difference amount). Example: Person Snow has purchased a 6 day course. At the end of the second day of the course, the person snow injures himself and gets a confirmation or medical certificate from the doctor that no more ski course is allowed. 2 course days will be charged according to the tariff list without discounts and the difference to the paid 6 day course minus the handling fee of € 25,- will be issued as a credit note. The ski course fee does not include the use of the ski lifts. The ski school will not compensate for lessons cancelled due to cable car lift failures and weather conditions.
8. Content of the online offer:
The ski school (hereinafter referred to as the "author") assumes no responsibility for the timeliness, accuracy, completeness or quality of the information provided. Liability claims against the author, which refer to material or immaterial nature caused by use or disuse of the information or the use of incorrect and incomplete information are excluded, unless the author is not intentional or grossly negligent fault.
All offers are subject to change and non-binding. The author expressly reserves the right to change, supplement or delete parts of the pages or the entire offer without prior notice, or to cease publication temporarily or permanently.

9. References and links:
In the case of direct or indirect references to external Internet pages ("links"), which lie outside the area of responsibility of the author, a liability obligation would only come into force in the event that the author has knowledge of the content and it would be technically possible and reasonable for it to prevent use in the case of illegal content.
The author hereby expressly declares that at the time the links were created, no illegal content was identifiable on the linked pages. 11. Place of performance, choice of law and place of jurisdiction:
The place of performance is located in 6767 Warth. The parties agree that Austrian law shall apply. For all disputes in connection with the present contractual relationship, the exclusive jurisdiction of the court having subject-matter jurisdiction for Warth is agreed.
12. severability clause:
Should individual provisions of these GTC be invalid, this shall not affect the validity of the remaining provisions or the entire legal transaction. The invalid provision shall be replaced by a provision that comes as close as possible to the invalid provision in economic terms.
